The worldwide trend is that tax disputes are on the rise with revenue authorities. Knowledge and navigational skills are key to the tax administration landscape in order to secure correct, transparent and fair treatment from the authorities.

The backbone of the SARS administrative processes is contained in the Tax Administration Act which came into operation in October 2012. The Act assists SARS to achieve its objections in an efficient and effective manner whilst also increasing the compliance levels of taxpayers. This one piece of legislation strives to incorporate the administrative provisions that are generic to all tax Acts, remove redundant administrative provisions and harmonise provisions as far as possible.

Presenter

Elle-Sarah Rossato

Elle-Sarah is an admitted attorney and associate director at KPMG. She is currently co-responsible for the Dispute Resolution and Tax Controversy Division in KPMG and assists clients on a daily basis to resolve complex tax disputes with SARS. She is a member of the Steering Committee of KPMG’s Global Dispute Resolution Network and presents regularly to tax practitioners at tax seminars and workshops.

Prior to joining KPMG, she worked at SARS for more than a decade where she was responsible for managing a legal and debt management specialised unit in the Enforcement Division.

Elle-Sarah contributes to tax thought in South Africa and regularly publishes articles in professional journals and other publications.


 

 

WHY REGISTER WITH SAIT?

Section 240A of the Tax Administration Act, 2011 (as amended) requires that all tax practitioners register with a recognized controlling body before 1 July 2013. It is a criminal offense to not register with both a recognized controlling body and SARS.
